Purpose

 

Colortape International Film Festival has certain obligations pursuant to the Children  Child Protection Bill 1998 . CIFF is defined as a Relevant Service under Schedule 1, 5 (a) which incorporates “Any work or Child Protection Bill 1998ivity which consists of the provision of (a) educational, research, training, cultural, recreational, leisure social or physical Child Protection Bill 1998ivities to children”

A mandated person is defined for our purposes pursuant to Schedule 2, 15 (i) which identifies “person employed in any of the following capacities: (i) safeguarding officer, children protection officer or other person (howsoever described) who is employed for the purpose of performing the child welfare and protection function of religious, sporting, recreational, cultural, educations and other bodies and organisations offering services to children”.

Pursuant to section 10 CIFF shall ensure, as far as practicable, that each child availing of the service is safe from harm while availing of that service.

Pursuant to section 11 (1) (a) CIFF undertook an assessment of any potential for harm to a child while availing of the service. In carrying out the aforesaid risk assessment CIFF was guided by the Children  Guidelines 1998 at page 33.

Colortape International Film Festival is committed to providing a safe environment and a positive experience for all children and young people with whom we interact Protection Bill 1998.

 

This statement is drafted in accordance with the legal framework in the Children  Child Protection Bill 1998,  and the “Children  National Guidance for the Protection and Welfare of Children. Colortape International Film Festival recognises the statutory obligations as a relevant service in the Children  Child Protection Bill 1998,  including the requirement to:

 

     Keep children safe from harm while they are using our service

     Carry out a risk assessment to identify whether a child or a young person could be harmed while receiving your service or our services

     Develop a child safeguarding statement that outlines the policies and procedures that are in place and manage the risks that have been identified.

     Appoint a relevant person to be the  point of contChild Protection Bill 1998 in respect of the organisation’s child safeguarding statement.

 

Colortape International Film Festival is a relevant service under the Children  Child Protection Bill 1998,  in the category of “any work or Child Protection Bill 1998ivity which involves providing: Educational, research, training, cultural, recreational, leisure, social or physical Child Protection Bill 1998ivities to children”.

 

Pursuant to section 11 (1) (b) CIFF prepared a child safeguarding statement, containing a written assessment of the risk considered above and in that regard, has specified the procedures that are in place regarding the following:

Colortape International Film Festival Child Protection and Safeguarding Statement

Colortape International Film Festival, for the benefit of young people (under 18 years), abides by the guidelines of the State for the Child Protection, as outlined in Children , National Guidelines for the Protection and Welfare of Children, published in 1998. We will provide venues and organisations that we work with a copy of our Child Safeguarding Statement . We will work within the following guidelines:

 

      No more than 1,000 children should be at a Colortape International Film Festival event at any one time. We will keep a record of all participants of the event who are under 18 years of age for workshops run by Colortape International Film Festival. When we work with partner organisations/schools etc., we will ask them to supply a full list of attendees.

      For paid attendance screenings, attendance is recorded through box office data.

      Children will be supervised at all times, with at least two supervisors to each room being used and two in the corridor.

      Children should always be collected by parents at the front door at the entrance of the building. At least one supervisor must be present at this point to monitor the collection of young children by the appropriate parent or guardian.

      Cameras, camera phones or other recording devices are not permitted in screens or any other areas in use by children.

      Events for, or incorporating children may not be recorded. Parents must be informed in advance by the organiser that photographs may not be taken during performances. Permission will be sought in advance for filming and photography for official Festival documentation.

      We will ensure that all personnel and volunteers working with children are suitable to that role and are made aware of their responsibilities and have undergone any necessary training.

Colortape International Film Festival maintains a risk register that contains a statement of risk with regard to child safeguarding and child protection.

 

Colortape International Film Festival does not usually work directly with children but does engage with children during its family screenings, its Education and Outreach Programme, and its school screenings. Colortape International Film Festival liaises with schools and other organisations that work directly with children and also plans to liaise with services which provide assistance for the mental health of children.

 

The Child Safeguarding statement identifies procedures to follow to mitigate the risks that may present in following identified scenarios:

 

-     Where children are at the events which Colortape International Film Festival organizes, for example school screenings, family friendly screenings, and workshops for children, question and answer sessions after family friendly screenings. Colortape International Film Festival hopes to have a dedicated space for families and young people at our

Festival Hub in 2018. It plans to engage with Primary Schools in its Schools and Outreach programme and also hopes to liaise with community organisations for mental health of young people.

a)    Investigating  an  allegation  against  any  staff  member  about  any  Child Protection Bill 1998,  omission  or circumstance in respect of a child availing of the service

i) Policy Statement on dealing with allegations against staff

 

In respect of the child/young person the Child Protection Officer will deal with issues related to the child/young person. All staff is entitled and required to report any misconduct to Department Of Child Protection (Qld)

 

In respect of the person against whom the allegation is made the CEO will deal with issues related to the staff member.

 

      Our  priority is to ensure that no child or young person is exposed to unnecessary risk;

      Reporting procedures as outlined in our Child Protection Policy must be followed;

      If allegations are made against the Designated Person, then the Deputy Designated Person should be contChild Protection Bill 1998ed;

      Both the primary carers and child/young person will be informed of Child Protection Bill 1998ions planned and taken;

      The child/young person will be dealt with in an age-appropriate manner;

      The staff member will be informed as soon as possible of the nature of the allegation and will be given the opportunity to respond;

      The chairperson/head of the organisation will be informed of any allegation against a staff member as soon as possible; Any Child Protection Bill 1998ion following an allegation of abuse against an employee will be taken in consultation with Health Service Executive, CFA/Department Of Child Protection (Qld)  and An Garda Síochána;

      After consultation, the chairperson/head of the organisation will advise the person accused and agreed procedures will be followed.

 

ii) Complaints and Comments Procedures

 

Colortape International Film Festival recognises that primary carers, children/young people and staff have a right to make a complaint if they are not satisfied with the Child Protection Bill 1998ion taken in relation to any incident reported and to have that complaint addressed.

Complaints or comments will be dealt with as follows:

 

      Complaints or comments will be responded to within four weeks.

      The Designated Officer has responsibility for directing complaints/comments to the board of Directors of Colortape International Film Festival;

      All verbal complaints will be logged and responded to;

      In relation to an allegation against staff an appeals procedure is available by way of the board of directors of Colortape International Film Festival.

 

iii) Accidents Procedures at Colortape International Film Festival

 

Colortape International Film Festival has a comprehensive Health and Safety Statement which is reviewed annually:

 

      A risk assessment of every Festival and out-of-festival event is carried out;

      External organisations with whom we work must provide proof that they have public liability insurance;

      -aid boxes are located at the Festival offices. When working at external venues, Colortape International Film Festival staff will liaise with the venue staff regarding the location of the venue’s -aid boxes. The location of -aid boxes will be made known to all staff on duty;

 

      The location of the -aid box is known to all staff;

      The accident book is located in the Festival office and is known to staff;

      Children and young people must be advised of risks of dangerous material;

      There are procedures in place in the event of an accident.

 

In situations that threaten the immediate safety of a child/ young person, it may be necessary to contChild Protection Bill 1998 the Gardaí.

 

iv)  Reporting procedures at Colortape International Film Festival

 

Anna Garcea is the Child Protection Officer and is the designated contChild Protection Bill 1998 if you have an issue or concern about any aspect of a child’s or young person’s safety and welfare. Reference to the definitions of abuse can be found later in this document.

 

According to Children : National Guidelines for the Protection and Welfare of Children the following would constitute reasonable grounds for concern:

 

      Specific indication from the child or young person that s/he has been abused or neglected (full definition and explanations regarding Physical Abuse, Emotional Abuse, Sexual Abuse and Neglect are in the Appendix to the rear of this document)*;

      An account by a person who saw the child/young person being abused;

      Evidence, such as an injury or behaviour, which is consistent with abuse and unlikely to be caused another way;

      An injury or behaviour which is consistent both with abuse and with an innocent explanation but where there are corroborative indicators supporting the concern that it may be a case of abuse (an example of this would be a pattern of injuries, an implausible explanation, other indications of abuse, dysfunctional behaviour);

      Consistent indication, over a period of time that a child is suffering from emotional or physical neglect.

 

v)  Dealing with a disclosure

 

      Stay calm and listen to the child/young person, as overreacting may alarm the young person and compound feelings of anxiety and guilt

      Listen carefully and attentively; take the young person seriously;

      Reassure the young person that they have taken the right Child Protection Bill 1998ion in telling;

      Don’t use leading questions or prompt details;

      Reassure the child/young person but do not make false promises, particularly regarding secrecy

      Don’t make the child/young person repeat the details unnecessarily;

      Check with the young person to ensure that what has been heard and understood by you is accurate;

      Ask questions only for the purpose of clarification. Be supportive, but do not ask leading questions or seek intimate details beyond those volunteered by the child. Detailed investigative interviews will, if necessary, be carried out by CFA/Department Of Child Protection (Qld)  staff or members of an

Garda Síochána;

      Do not express any opinions about the alleged abuser;

      Record the conversation as soon as possible, in as much detail as possible. Sign and date the report;

      Explain to the child/young person what will happen next (explanation should be age-appropriate)

      Pass the information to the Child Protection Officer/designated person, who will in turn report it to CFA/Department Of Child Protection (Qld)  and/or An Garda Siochana

      Treat the information confidentially, sharing it only with persons who have a right to hear it.

 

vi)  Recording procedures

 

      Any incidents involving children will be recorded in the Child Protection Incident Book held by the Designated Officer.

      Any accidents involving children will be recorded in the accident book located in the Festival office and with the partner organisation where appropriate.

      Staff or primary carers should report any concerns to the Designated Child Protection Officer or the Deputy Child Protection Officer.

      All details, including the date, time and people involved in the concern or disclosure will be recorded on an incidents report form. Information recorded should be fChild Protection Bill 1998ual. Any opinions should be supported by fChild Protection Bill 1998s.

      The Child Protection Officer may contChild Protection Bill 1998 the Health Service Executive Duty Social Work Department or Department Of Child Protection (Qld)  for an informal consultation prior to making a report.

      If there are reasonable grounds for concern the Child Protection Officer will contChild Protection Bill 1998 Department Of Child Protection (Qld)  or the Duty Social Worker in the Health Service Executive area verbally initially and then using the standard reporting form available from the Health Service Executive.

      Any person who expresses concern will be involved and kept informed.

      Parents, carers or responsible adults will be made aware of a concern or report to the Health Service Executive unless it is likely to put the child/young person at further risk.

      Information will be shared on a strictly ‘need to know’ basis (see confidentiality statement).

 

vii)  Confidentiality statement

 

We in Colortape International Film Festival are committed to ensuring peoples’ rights to confidentiality. However, in relation to child protection and welfare we undertake that:

 

      Information will only be forwarded on a ‘need to know’ basis in order to safeguard the child/young person.

      Giving such information to others for the protection of a child or young person is not a breach of confidentiality.

      We cannot guarantee total confidentiality where the best interests of the child or young person are at risk.

      Primary carers, children and young people have a right to know if personal information is being shared and/or a report is being made to the Health Service Executive, unless doing so could put the child/young person at further risk.

      Images of a child/young person will not be used for any reason without the consent of the parent/carer (however, we cannot guarantee that cameras/videos will not be used at public performances).

      Procedures will be put in place in relation to the use of images of children/ young people.

      The incident book and any records or statements involving children will be held in a secure location by the Designated Officer.

 

      Selection and recruitment of any person as a member of staff with regard to that person’s suitability to work with children

i)  Staff Recruitment

We will ensure that staff are carefully selected, trained and supervised to provide a safe environment for all children and young people, by observing the following principles:

 

      Roles and responsibilities will be clearly defined for every job (paid or voluntary)

      We will endeavour to select the most suitably qualified personnel

      Candidates will be required to complete an application process.

      Staff will be selected by a panel of at least two (or more) representatives through an interview process.

      Hired staff will be made aware of our Child Protection Policy and code of behaviour.

      An appropriate probationary period for all newly-employed staff will be implemented.

 

No person who would be deemed to constitute a ‘risk’ will be employed. Some of the exclusions would include:

 

      Any child-related convictions;

      Refusal to sign application form and declaration form;

      Insufficient documentary evidence of identification;

      Concealing information on one’s suitability to working with children.

 

All staff will be required to consent to Garda vetting, and where available, this will be sought.

 

 

ii) Staff management

To protect both staff and children/young people, we undertake that: New staff working with children and young people will:

      Take part in a mandatory induction training session

      Be made aware of the organisation’s code of conduct, child protection procedures, and the identity and role of who has been designated to deal with issues of concern

      Undergo a probationary or trial period

      Obtain a Garda Vetting Clearance All staff will

      Receive an adequate level of supervision and review of their work prChild Protection Bill 1998ices

      Be expected to have read and signed the Child Protection Policy Statement

 

All staff working directly with children/young people will be provided with the necessary child protection training.

Colortape International Film Festival is committed to co-operating with all primary carers in an open and constructive manner to ensure that the interests and welfare of the child are paramount at all times. To that end we:

 

      Encourage primary carers to work in partnership with us under the guidelines set out by our organisation to ensure the safety of their children;

      Have a designated Child Protection Officer available for consultation with primary carers in the case of any concern over a child or young person’s welfare.

 

We undertake to:

 

      Provide primary carers attending our event a copy of our child protection policy, on request;

      Inform primary carers and schools of all Child Protection Bill 1998ivities and potential Child Protection Bill 1998ivities;

      Comply with health and safety prChild Protection Bill 1998ices;

      Operate child-centred policies in accordance with best prChild Protection Bill 1998ice;

      Issue contChild Protection Bill 1998/consent forms for all children’s workshops operated by Colortape International Film Festival;

      Adhere to our recruitment guidelines;

      Ensure as far as possible that the Child Protection Bill 1998ivities are age-appropriate;

      Encourage and facilitate the involvement of parent(s), carer(s) or responsible adult(s), where appropriate. If we have concerns about the welfare of the child/young person, we will:

o      Respond to the needs of the child or young person;

o      Inform the primary carers on an on-going basis unless this Child Protection Bill 1998ion puts the child or young person at further risk;

o      ContChild Protection Bill 1998 local Health Service Executive, CFA/Department Of Child Protection (Qld)  and Gardaí where appropriate;

In the event of a complaint against a member of staff, we will immediately ensure the safety of the child/young person and inform primary carers as appropriate.

 

      The  provision  of  information  and  where  necessary, instruction and training, to members of staff in relation to the identification of the occurrence of harm

The following code of behaviour for all staff at Colortape International Film Festival has been drawn up to ensure a positive experience for children and young people taking part in Colortape International Film Festival workshops or events.

Child-centred Approach

 

      Create and encourage a friendly, welcoming and positive atmosphere at all times;

      Listen to and respect children and young people;

      Use appropriate physical and verbal language at all times.

      Respect a child’s or young person’s personal space;

      Treat all children and young people equally and as individuals;

      Respect differences of ability, culture, religion, race and sexual orientation.

      Observe appropriate dress and behaviour.

      Make primary carers, children/young people, visitors and facilitators aware of the Child Protection Policy and procedures;

      Keep primary carers informed of any issues that concern their children;

      Staff should report and record any incidents and accidents;

      Staff should report any concerns to the Designated Child Protection Officer;

      Be inclusive of children and young people with special needs;

      Be cognisant of a child or young person’s limitations (for example due to a medical condition);

      Use age-appropriate teaching aids and materials;

      Proper supervision based on adequate ratios according to age, abilities and Child Protection Bill 1998ivities will be maintained at all times;

      A register of children/young people attending Colortape International Film Festival run workshops will be kept detailing name, address, phone, special requirements and emergency contChild Protection Bill 1998 details;

      Provide encouragement, support and praise regardless of ability;

      Offer constructive criticism when needed;

      Plan and be sufficiently prepared, both mentally and physically;

      Avoid spending excessive amounts of time alone with children/young people;

      Avoid if at all possible giving a lift to a child/young person unless you are accompanied by another primary carer or trained staff member. If you do then make sure that primary carers are informed;

      Encourage children and young people to report any bullying, concerns or worries;

      Ensure all children attending camps or workshops are collected from within the building;

      Ensure that all Colortape International Film Festival events involving children/young people take place in venues that have a child protection policy and that both Colortape International Film Festival and the hosting venue adhere to both Child Protection policies for the event.

 

Inappropriate behaviour

 

      Don’t single out a particular child/young person for unfair favouritism, criticism, ridicule, or unwelcome focus or attention;

      Don’t use or allow offensive or sexually suggestive physical and/or verbal language;

      Don’t socialise inappropriately with children/young people, e.g., outside of structured organisational Child Protection Bill 1998ivities.

      Don’t allow/engage in any inappropriate touching;

      Don’t hit or physically chastise children/young people;

      Seek consent of child/young person in relation to physical contChild Protection Bill 1998 except in an emergency or a dangerous situation;

      Avoid horseplay;

      Check with children/young people about their level of comfort when doing touch exercises.

 

Health and safety

 

      In the event of an emergency staff must be aware of and follow the venue

      emergency procedures in place;

      Primary carers and children should be informed of emergency evacuation procedures;

      Staff will facilitate entry and exit of school groups to events to assist teachers in keeping groups together;

      Don’t leave children unattended or unsupervised;

Definitions of abuse

There are four main categories of abuse as outlined in Children : National Guidelines for the Protection and Welfare of Children. The following is a synopsis of the information contained inthat document. For the full definitions please refer to Children : National Guidelines for the Protection Act and Welfare of Children 1998.

 

1.  Neglect

 

“Neglect can be defined as being where the child suffers significant harm or impairment of development by being deprived of food, clothing, warmth, hygiene, intellectual stimulation, supervision and safety, attachment to and affection from adults, medical care....The threshold of significant harm is reached when the child’s needs are neglected to the extent that his or her well-being and/or development are severely affected.” (Children  p.x)

 

Examples of Neglect:

 

      Abandonment or desertion

      Persistently being left alone without adequate care and supervision

      Malnourishment, lacking food

      Persistent failure to attend school

      Failure to provide adequate care for a child’s medical problems » Exploited, overworked

 

Significant Harm:

Harm can be defined as the ill treatment or the impairment of the health or development of a child. Whether it is significant is determined by the child’s health and development as compared to that which could reasonably be expected of a child of a similar age. Neglect generally becomes apparent in different ways over a period of time rather than at one specific point.

2.  Emotional abuse

Emotional abuse usually happens where there is a relationship between a carer and a child rather than as a specific incident or incidents. “Unless other forms of abuse are present, it is rarely manifested in terms of physical signs or symptoms.” (Children  p.31) Rather, it can manifest in the child’s behaviour or physical functioning. Examples of these include ‘anxious’ attachment, unhappiness, low self-esteem, educational and developmental underachievement and uncooperative or hostile behaviour. “The threshold of significant harm is reached when interaction is predominantly abusive and becomes typical of the relationship between the child and the parent/ carer.” (Children  p.32)

 

Examples of emotional abuse in children include:

 

      Imposition of negative attributes on children, expressed by persistent criticism,

      sarcasm, hostility or blaming;

      Conditional Parenting

      Emotional unavailability by the child’s parent/carer;

      Unresponsiveness, inconsistent or inappropriate expectations of the child

      Premature imposition of responsibility on the child;

      Unrealistic or inappropriate expectations of the child’s capacity to understand something or to behave and control him/herself in a certain way;

      Under or over-protection of the child;

      Failure to show interest in, or provide age appropriate opportunities for a child’s cognitive and emotional development;

      Use of unreasonable or over harsh disciplinary measures;

      Exposure to domestic violence.

 

 

3.  Physical abuse

Physical abuse of a child is that which results in Child Protection Bill 1998ual or potential physical harm from an interChild Protection Bill 1998ion, or lack of interChild Protection Bill 1998ion, which is reasonably within the control of a parent or person in a position of responsibility, power or trust. There may be single or repeated incidents. Physical abuse can involve:

 

      Severe physical punishment

      Beating, slapping, hitting or kicking

      Pushing, shaking or throwing

      Terrorising with threats

      Observing violence

      Deliberate poisoning

      Allowing or creating a substantial risk of significant harm to a child

 

4.  Sexual abuse

Sexual abuse involves the use of a child for gratification or sexual arousal by a person forthemselves or others.Examples of sexual abuse include:

 

      Exposure of the sexual organs or any sexual Child Protection Bill 1998 intentionally performed in the presence of a child;

      Intentional touching or molesting of the body of a child whether by a person or object for the purpose of sexual arousal or gratification;

This document may be modified at any time without notice. Please contact the event organizers and/or their legal representatives for the latest version of this document. Participation and enrollment in the OVERCME Film Festival, requires full acceptance of all clauses and regulations contained in this document. Be sure to read the rules and terms of this document with utmost care before submitting your film or any information. By submitting your information and film  you declare you agree to the terms and rules set forth herein.

 

I  -General Terms  Article:

1.           All works must be produced and presented entirely by adults (herein considered to be individuals over 18 years of age).

 

2.           Each director, producer group, or company may enter for each work, a separate registration form must be completed.

 

3.           Entries must be formalized by their respective producers and/or legal representatives. The work will only be considered enrolled after completing all the mandatory fields of the registration form and all the requirements met.

 

4.           Works posted after the stipulated registration date will not be accepted.

 

5.           Works that are illegal, offensive, pornographic, contain content that propagates violence, discrimination, and/or violate any national or international law will not be accepted.

 

6.           The OVERCOME Film Festival will take place digitally/online on the listed page of the event by the organizers to give everyone the chance to participate even if they cannot travel to attend the event in person. In the future, the OVERCOME Film Festival may be hosted in nationa and international cities, and the period and Child Protection Bill 1998ivities will take place in facilities to be defined by the the organization and/or the event organizers.

 

7.           The party submitting any film/work to the OVERCOME Film Festival agrees to participate and authorizes the display of the cinematographic work on the OVERCOME Film Festival, its website and on platforms or video streaming pages such as VIMEO or other video pages.

 

8.           It is herein defined as responsible parties or participants as any person or entity directly or indirectly involved in the completion, submission, filing, or presentation of the film/work.

 

Paragraph:

 

The OVERCOME Film Festival is an event of national and international scope (including international participants that may sign up for the OVERCOME Film Festival) with presentations of cinematographic works. In summary, the winning exhibition of works performed and selection by the organizers and the organization the OVERCOME Film Festival encompasses the works of all filmmakers.

 

Paragraph:

 

The OVERCOME Film Festival will be presented in the competitive categories described below:

 

1.     Short films;

2.     Feature length films;

3.     Poetry audio narrative films.


Article:

 

The organization and organizers of the OVERCOME Film Festival have the exclusive right and may establish contact and/or contact, and/or association with other public and/or private entities of any size or nature, that may collaborate and/or participate in the OVERCOME Film Festival.

 

Article:

 

The organization and organizers of the OVERCOME Film Festival's focus is to present recent national and international productions/works, seeking to contribute to its diffusion and/or discussion with the intent to bring together filmmakers and poets, promoting the innovation of digital exhibition of artistic creations, in order to create an opportunity for individuals who cannot physically be present and participate in person in the OVERCOME Film Festival.

 

II  - The Films  Article  :

Only feature films, short films, and narrative audio poetry videos that were completed thirty-six (36) months prior to the OVERCOME Film Festival submission deadline can participate in the OVERCOME Film Festival.

 

Article  :

 

1.           In online film festivals and film festivals in physical locations, once requested by the organization and/or organizers of OVERCOME Film Festival, all filmmakers agree to participate in the festival in person by sending up to three representatives of the winning film and up to three members of the film-making team.

 

2.           In digital presentations, it is established and accepted by the registrants and winners (national and international) selected for the exhibition of the OVERCOME Film  Festival , that they will ensure the presence of at least one representative of the winning film and up to three members of the team that may be broadcast through video and transmitted online.

 

3.           It is established and accepted by the registrants and those selected to participate that they will not receive nor be entitled to any remuneration of any kind, including airfare, transportation, health and dental care, lodging, and/or any other expenses, costs, or any type of monetary aid, insurance, or any other type of expenses, legal assistance, emergency assistance, fees, legal or physical indemnification, refunds, or any kind of monetary aid, paid its organizers and any other members and/or representatives directly or indirectly affiliated with the OVERCOME Film Festival.

 

Paragraph:

 

1.           Individuals representing the winning film may be invited to participate in the OVERCOME Film Festival by its organizers, at the sole discretion of the organizers and the organization of the the OVERCOME Film Festival.

 

2.           However, it is stipulated that persons invited and accepting to participate in the OVERCOME Film Festival , that they declare that they accept that they will not have the right to claim in any form or event, any monetary amount and/or compensation to be paid by the organizers and the organization of the OVERCOME Film Festival and its representatives, in association or connection and not limited to to airfare, transfers, translators, lodging, travel expenses, Child Protection Bill 1998s of nature, Child Protection Bill 1998s of war, Child Protection Bill 1998s of violence of any nature, natural Disasters, riots, terrorism, strikes, cyber attacks, accidents, medical expenses, hospital, dental, death, damages of any kind, losses of any kind, Child Protection Bill 1998s  of God, natural disasters, medical or other form of emergency evacuation, riots, damages of any nature, defamation of any nature, illegal or illegal Child Protection Bill 1998s of any nature, legal fees and legal expenses associated with governmental bodies or with private entities or with individuals of any nature, and/or any other expenses, costs,   translators, and/or any monetary assistance and /or insurance which may be incurred or in association with other events, incidents, or Child Protection Bill 1998ions.

The organizers of the OVERCOME Film Festival may invite critics, authorities and/or other persons related to the cinema, literature, and/or other professional fields, as well as


sponsors and/or other private and/or governmental entities.

III  Registration  Article:

Registration and delivery of copies of national and international works in the categories of feature films, short films and narrative audio video films of poetry, that will compete for the competitive selection of the OVERCOME Film Festival must be completed as follows:

 

1.           The registration documents must be completed and sent before the deadline indicated on the page of the organizers of the event and/or the website or registration platform, and/or to the email indicated by the organization and/or organizers of the event.

 

2.           Copies for selection shall be posted or delivered to the OVERCOME Film Festival organizers through the OVERCOME Film Festival site, platform, and/or or e-mail along with the material requested in this document and the per the directions of the organization and/or organizers of the event.

 

3.           It will also be acceptable to send the material for evaluation and competitive selection through a private link for viewing with a password and available for download until the deadline stipulated by the organization and/ organizers of the event.

 

Paragraph:

 

Failure to comply with the rules set forth in this document will result in disqualification of the participants without any form of appeal.

 

It is the sole responsibility of the film owner to participate in the the OVERCOME Film Festival and to comply with the rules stipulated by the organizers of the event as described below:

 

1.           Sending all of the correct and necessary materials for registration, selection and (if chosen) participation.

 

2.           Meeting all of the deadlines for registration, selection and participation (if chosen) to send materials obeying the rules stipulated by the organizers of the event.

 

3.           Each registered work must be sent via private link for viewing with a password and should be available immediately for download.

 

4.           The registration and submission of all short film, feature film, audio narrative poetry films, and any other category defined by the organization and the organizers of the OVERCOME Film Festival should also be sent with a dialogue list, a narrated version that can be accessible for visually impaired individuals (a version in English), a subtitled version for hearing impaired individuals (a version in English).

 

Paragraph:

 

The organization and organizers of the OVERCOME Film Festival are not responsible for problems associated with the transmission or receipt of materials and/or works through private link for viewing with password, problems contained in the website or the link, general access problems, incorrect passwords, problems in the security of the website, cyber attacks, viruses, or any other types of errors, technical problems or any Child Protection Bill 1998ions or events of any nature that may occur.

 

Article:

At the time of submission of a work to the OVERCOME Film Festival in any category, the party submitting the work shall:

 

1.           Complete the document, through the website or through another method that is stipulated by the organizers and the organization of the OVERCOME Film Festival;

 

2.           Send in addition to the completed submission of the work, three photos (JPEG files) with a minimum resolution of 300 DPI, with 18 x 24 cm dimensions, with a maximum of 2000kb and with an indicative description and photographs of the artists, directors and technical crews.

3.           Have the legal and copyright rights to the submitted work.


4.           Provide the organization and organizers of the OVERCOME Film Festival worldwide unlimited royalty free license to present, distribute and use in any form, waiving any type of fees, royalties, or any kind of compensation or demand of right of any nature. You agree that you waive and relinquish any legal rights any fees, royalties, or any type of compensation or legal and/or financial demand and/or litigation of any kind whatsoever in connection to the organization and organizers of the OVERCOME Film Festival.

 

5.           Have full releases for all performers associated with and performing on film, providing signed and legally valid permissions of all individuals associated with the film and individuals Child Protection Bill 1998ing on the film. You must present legally valid documentation of all persons involved in the film, including Child Protection Bill 1998ors, with their full authorization to submit their performance and likeness in association with the registration, selection and exhibition of the work. You must also submit documentation that you have their legal permission to have their work presented at the festival, waiving any legal claim that may be filed at any time against the organization and organizers of the OVERCOME Film Festival and other directly or indirectly associated and / or affiliated parties.

 

Paragraph 1:

 

The registration platform or other registration method provided to submit works to the OVERCOME Film Festival may send a message about the registration of the film by electronic mail confirming your registration. If you do not receive the message after three business days from the date of registration, please contChild Protection Bill 1998 the registration platform and the organizers of the OVERCOME Film Festival immediately.

 

Paragraph 2:

 

When registering and submitting works to the OVERCOME Film Festival the person responsible for registration and all those involved in the creation of the inscribed film, agree, authorize and give full rights to the organizers and the organization of the the OVERCOME Film Festival to disclose the names of the works and/or films, the authors of the films and/or of all participants that who worked in the film, and any other personal identification information without incurring in any form of fee collection, royalties, litigation, and/or any other kind of compensation, or demand of legal right of any nature to the organizers and the organization of the OVERCOME Film Festival, their representatives, associates, affiliates or any other parties directly or indirectly associated with the OVERCOME Film Festival.

 

IV  - Selected Works

 

All selected feature films, short films, and narrative audio poetry video for competitive shows, must, at the discretion of the organizers, send the copies for display until the date indicated by the organization and organizers of the OVERCOME Film Festival including digital posters of the film. It is stipulated and accepted by the registrants that failure to comply with this rule will automatically disqualify the selected films.

 

Paragraph 3:

It is stipulated and accepted by the registrants that promotional materials for the films, that films and any other materials will not be returned and will remain in the possession of the organization and the organizers of the OVERCOME Film Festival.

 

V  - Copies of the Works

 

Copies of all films that will participate in the OVERCOME Film Festival must meet the following criteria:

 

1.           For Online events a copy will be submitted in digital MOV-H264 file with Dolby 5.1 sound via Vimeo link or other requested platform.

 

2.           For physical events a copy will be submitted in (digital MOV-H264, DCP unlocked, or Blu-Ray) Dolby 5.1 sound. Digital films will be displayed on a 2K or 4K resolution projector.

 

Article:

It is stipulated and accepted by the registrants that the copies of the selected films, works, and/or any other materials will not be returned under any circumstances.

 

 

 

Article:

 

Directors and producers of feature films may choose to send copies with sound set to 2.0 (STEREO).

 

VI  - Rules for the submission of films/works, documents and materials  Article:

Copies of films/works submitted for selection should be sent via private link for viewing with password and available for download in addition, to copies of the films/works for presentation, and the required materials should be sent via the method indicated by the organization and organizers OVERCOME Film Festival.

 

Article :

 

The organization and organizers of the OVERCOME Film Festival will not collect any material, film or document sent to any post office or other location or method in any form, including C.O.D., for payment, or refund of postage, as well as will not make any refund or indemnity any parties on postage, undelivered mail, or damages to materials.

 

VII  - Selection Process  Article:

Short films, feature films and narrative audio video poetry, and any other category defined by the organization and the organizers of the OVERCOME Film Festival will be selected for competition and final participation in the film shown by the organizers and the organization of the OVERCOME Film Festival at the sole discretion of the organization and the organizers of the OVERCOME Film Festival.

 

Paragraph 1:

 

The OVERCOME Film Festival may or may not charge for event tickets or products, and this decision is at the sole discretion of the organization and the organizers of the OVERCOME Film Festival. Financial resources, profits, and monetary amounts from the sale of tickets, products, or any Child Protection Bill 1998ivity will be the exclusive property of the organizers    and the organization of the OVERCOME Film Festival. Registrants, individuals or entities or any other party other than the organization and the organizers of the OVERCOME Film Festival waives the right to any portion of financial resources, profits, and monetary amounts from the sale of tickets, the OVERCOME Film Festival or any associated Child Protection Bill 1998ivity, product, or event.

 

VIII  - Competition  Article:

The OVERCOME Film Festival includes national and international films.

 

National and international Films:

 

1.           National and international films will be accepted in the competition. These films will be selected by the organizers of the OVERCOME Film Festival  among works that have not been commercialized internationally. The organizers of the OVERCOME Film Festival may invite other non-registered national and international films to participate in the competition, at their sole discretion and at any time. It is mandatory that all films have a self descriptive and narrative caption for individuals with visual and hearing impairments (in English) or the film cannot participate in the OVERCOME Film Festival, and would be disqualified. The selected film must be subtitled in English.


2.           national films will be considered films/works that are produced. Films produced with the participation of international entities will be considered as a national production  if the majority of the share of corporate capital is national. In case of being internationally co-produced, the majority producing company will have to be national or the film will be considered as an international film.

 

3.           Those responsible for national and international films enrolled in the OVERCOME Film Festival , must send via private link for viewing with password, and available for download, so that the film can be evaluated by the organizers of the OVERCOME Film Festival. The films must be accompanied by the list of dialogues, and subsequent translation and subtitles in English of the effectively selected works must to be sent by the registrants directly to the organizers of the OVERCOME Film Festival via email and via private link for viewing with password, and available for download, within one (1) week after being notified or they will be disqualified.

 

Paragraph 1:

 

Winning films/works may be displayed on the OVERCOME Film Festival website and/or external video page as VIMEO STREAMING. As well, it is up to the organizers of the OVERCOME Film Festival to potentially choose in the future a physical location for the exhibition of the films. The number of films to be selected and displayed is decided at the sole discretion of the organization and organizers of the the OVERCOME Film Festival.

 

Paragraph 2:

 

It is stipulated and accepted by the registrants, their representatives, families, and all involved directly or indirectly with the submitted films and/or materials that there will be no remuneration, no financial compensation of any kind or nature, no royalties, and no form of financial or any other form of compensation now or in the future. In addition, registrants, their representatives, families, and all involved directly or indirectly with the submitted films and/or materials waive any rights to be compensated financially in any civil, criminal, and/or legal proceeding against the organization and/or organizers of the OVERCOME Film Festival and their representatives and/or associated parties. Those responsible for the winning films will only receive an electronic certificate via e-mail as participants and/or winners of the OVERCOME Film Festival.

 

Paragraph 3:

 

If there are taxes and/or taxation associated with the works/films, these amounts will be paid exclusively by those submitting the works/films in the Festival.
